Terms of service

These terms cover your use of Arkitype. They are written to be read, not to be skipped. Using the product, or paying for it, means you accept them.

You are contracting with Srinidhi Bhat, trading as Arkitype — a sole trader, not an incorporated company. Where these terms say “we”, that is who they mean.

Your work is yours

You own every design system you create here and everything you upload into one. We claim no rights over it. We hold it to run the service — storing it, showing it to people you have shared it with, compiling it into the exports you ask for — and for nothing else.

We do not use your work to train models. Not ours, not anyone else's, not in aggregate, not de-identified.

You give us only the permission needed to do the above, and it ends when you delete the content or your account.

Accounts

Keep your credentials to yourself; anything done from your account is treated as done by you, and you should tell us promptly if you think that is no longer true. An account belongs to one person — a team shares an organization, not a login, which is what makes an audit trail mean anything.

You must be old enough to enter a contract where you live, and if you are agreeing on behalf of a company you must have the authority to do so.

Plans, payment and renewal

• Free stays free. 3 design files, 8 MB each, and every export the paid plans have. No card, and no expiry.
• Paid plans renew automatically for the same period until you cancel. Prices are shown on the pricing page before you buy, exclusive of tax unless stated.
• Seats are billed per person on plans that say so. Adding someone mid-period is charged pro rata; removing someone takes effect at the next renewal.
• Cancel any time, from the billing portal in Settings. You keep the plan until the end of the period you have paid for. We do not refund part of a period, except where the law requires it or where we have got something badly wrong — ask, and we will be reasonable.
• If a payment fails, nothing changes immediately. We keep you on your plan while the card is retried and we will email you. Only once those retries are exhausted does the organization drop to the free plan's limits.
• If we change a price, you get at least 30 days' notice before it applies to your renewal, and you can cancel instead.

What happens if you stop paying

Your work is not deleted and not locked. The organization returns to the free plan's limits: everything you already have stays readable, editable and exportable, and you are asked to get under the limit before creating anything new. Published styleguides beyond the free allowance stop being served until you unpublish the extras or resubscribe.

We do not hold design systems hostage. Settings → Account → Download my data works on every plan, including after you have cancelled.

What you agree not to do

• Upload anything you do not have the right to upload.
• Store or publish material that is unlawful, or that infringes somebody else's rights.
• Attack the service: probing for vulnerabilities in order to exploit them, overwhelming it, or working around its limits. Responsible security research is welcome and is covered by a published policy — see security.txt.
• Resell access, or run the service on somebody else's behalf as a product of your own.
• Use the service to build a directly competing product.

Availability

We aim for the service to be available and we do not offer a contractual uptime guarantee on the plans sold here. Planned maintenance is announced in advance where we can. An enterprise agreement can carry a service level; write to sales@arkitype.srinidhibhat.com.

We keep backups and we test restores — see the trust page — and we still recommend exporting anything you cannot afford to lose.

Your data

The privacy notice says what we hold and why. Where you use the service to process personal data and data protection law applies, the data processing agreement forms part of these terms and takes precedence on anything concerning personal data.

Warranties and liability

The service is provided as it is. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Neither of us is liable for indirect, incidental or consequential loss, or for lost profits, revenue or data. Our total liability for any claim is limited to the greater of the fees you paid us in the twelve months before the claim arose, or fifty US dollars.

None of this limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Ending it

You can delete your account at any time from Settings, and everything you own goes with it. If you own a shared organization that other people are in, transfer it first — deleting your account must not delete their work.

We may suspend or end an account that breaks these terms. Except where the breach is serious enough to need immediate action, we will tell you what is wrong and give you a reasonable chance to fix it, and we will say why either way.

If we discontinue the service, you get at least 30 days' notice, a working export, and a pro-rata refund of anything you have paid for time you will not get.

Changes to these terms

We will email you at least 30 days before a material change takes effect. If you do not accept it, cancel before it applies and we will refund the unused part of your term. Continuing to use Arkitype after that means accepting the new version.

Law, and how a disagreement gets resolved

These terms are governed by the law of Karnataka, India, and its courts have exclusive jurisdiction. If part of these terms turns out to be unenforceable, the rest stays in force.
